PlagiusOne (SaaS) Terms of Use

Responsible company: GH SOFTWARE LTDA., headquartered in Porto Alegre/RS, Brazil ("GH Software", "we").
Service: PlagiusOne online platform (plagiarism and AI detector) available at plagius.one and associated domains ("Service").
IMPORTANT: By creating an account, accessing, or using the Service, you agree to these Terms of Use. If you do not agree, do not use the Service.
1. Definitions
- User/Customer: individual or legal entity that creates an account and uses the Service.
- Account: the User's access credentials and profile.
- Plan: set of features, limits, credits, terms, and prices offered.
- Credits: unit that measures Service consumption (e.g., per analyzed words).
- Content: texts, documents, and data submitted by the User for analysis.
- Documentation: help materials and technical information.
2. Acceptance and changes to the Terms
These Terms may be updated to reflect legal, technical, or Service changes. We will notify material changes through reasonable means (e.g., email, dashboard notice). Continued use after an update means you agree to the new Terms.
3. Registration, eligibility, and Account security
3.1. You must provide true, complete, and up-to-date information.
3.2. You are responsible for keeping your credentials confidential and for all activity performed through the Account.
3.3. Sharing credentials, bypassing access controls, or allowing unauthorized use is prohibited.
3.4. The Service is not intended for children under 13. For teenagers, comply with applicable law and ensure responsible supervision.
4. Plans, credits, digital service delivery, and usage limits
4.1. Plans define limits (e.g., volume of words per day or month), features, and prices.
4.2. Credits may be tied to a subscription; they do not roll over between billing cycles unless the Plan expressly states otherwise; they expire at the end of the respective cycle or within the term stated in the Plan or contract.
4.3. Promotional credits (e.g., trial) may carry additional restrictions and shorter validity.
4.4. Usage beyond the limits may be blocked, billed separately, or require a Plan upgrade.
4.5. As a rule, purchasing Plans or credits grants immediate access to the Service, unless otherwise indicated at the time of purchase. The User acknowledges that accessing the dashboard and using credits constitutes the start of digital service delivery.
4.6. The User agrees that credits actually consumed and analyses already performed will not be refunded or re-credited due to disagreement with the result, misinterpretation of reports, or decisions made based on them, except where required by applicable law or expressly provided for in a specific Plan.
5. Trial period, offers, and tests
We may offer free trials, free plans, or promotional credits with time and usage restrictions. Such terms are discretionary and may be changed or ended at any time.
6. Payments, billing, default, and taxes
6.1. Subscriptions are prepaid and renew automatically for the selected term until cancelled.
6.2. Prices may be updated; when they change, we will provide reasonable prior notice.
6.3. Applicable taxes will be added pursuant to the governing law.
6.4. Payments are processed by third parties (e.g., payment gateways). We do not store any financial or credit card data, not even partially â all processing is performed exclusively by payment intermediaries.
6.5. Nonâpayment, refusal of a charge by the payment method used, or a dispute/chargeback that is deemed unfounded under the applicable rules may be treated as default with respect to the amounts due.
6.6. In the event of default (including an unfounded chargeback), GH Software may suspend or restrict access to the Account and/or Service, in whole or in part, until outstanding amounts are settled, without prejudice to other remedies available under these Terms and applicable law.
6.7. The User remains responsible for all amounts corresponding to digital services already made available and used, even if they later cancel the subscription or close the Account.
6.8. GH Software may refer overdue amounts to thirdâparty collection agencies or legal counsel, pursue judicial or extrajudicial collection measures, and (where permitted by law) report delinquent accounts to credit reporting agencies, observing applicable legal requirements.
6.9. Any fees or charges applied by card networks or payment intermediaries in connection with unfounded disputes or chargebacks (such as dispute/chargeback handling fees) may be passed on to the User responsible for the transaction, where permitted by applicable law and payment network rules.
7. Cancellation, refunds, and coolingâoff rights
7.1. You may cancel automatic renewal at any time through the dashboard; access remains available until the end of the cycle already paid. Cancellation stops future recurring charges but does not, by itself, entitle you to a refund of amounts already paid, except as provided in this clause or required by applicable law.
7.2. If a mandatory coolingâoff or withdrawal period applies in your jurisdiction, you may exercise such right within the legally prescribed period, provided no credits have been used and the digital service has not yet been consumed, in accordance with applicable consumer protection rules.
7.3. Credits already consumed and analyses already performed generally indicate that the digital service has started to be provided and will not be refundable, except where applicable law requires otherwise.
7.4. Unused credits may be refunded when required by applicable law or expressly provided by the relevant Plan, in accordance with the payment method used.
7.5. Outside mandatory legal withdrawal periods and any specific refund terms set out in a Plan, amounts paid are nonârefundable to the fullest extent permitted by law.
8. Acceptable use and restrictions
8.1. It is prohibited to:
(a) violate laws, third-party rights, or these Terms;
(b) attempt to bypass technical limits, reverse engineer, decompile, copy, redistribute, or create derivative works of the Service or Documentation;
(c) perform any type of automated access, including robots, bots, scripts, crawlers, spiders, or unauthorized integrations;
(d) exploit vulnerabilities, perform abusive scraping, load tests, attacks, or interfere with the Service's stability;
(e) submit unlawful Content, third-party confidential information without authorization, or Content that violates privacy, intellectual property, or academic or business confidentiality.
8.2. We may suspend, restrict, or terminate access to the Account and/or Service, in whole or in part, in case of misuse, violation of these Terms, suspected fraud, abusive use, breach of technical limits, or payment default (including unfounded chargebacks), subject to any mandatory legal procedures.
8.3. Suspension or blocking measures may, where reasonable and lawful, extend to all Accounts that can be clearly linked to the same holder (e.g., same verified email or billing identity), when there are indications they are being used together to circumvent limits, commit fraud, or bypass legitimate restrictions.
9. Results, responsibility, and "as is" use
9.1. PlagiusOne is a tool that assists in detecting potential indications of plagiarism and AI-generated content, based on statistical and probabilistic methods; its results are subject to errors, false positives, and false negatives.
9.2. The interpretation of the results and the final decision on whether plagiarism or AI-generated content exists rest exclusively with the User.
9.3. The Service is provided "as is", without guarantees that it will detect all cases or be fit for specific purposes.
9.4. Limitation of liability: to the maximum extent permitted by law, our total liability for damages arising from use of the Service is limited to the amount paid in the 12 (twelve) months preceding the event that caused the damage. We are not liable for lost profits, loss of opportunity, business interruption, or indirect damages, except when prohibited by applicable law.
9.5. GH Software is not responsible for misinterpretations of generated reports nor for decisions made solely based on them; the User remains responsible for reviewing results and applying their own judgment.
9.6. By accepting this responsibility term, the User assumes full responsibility for uses, decisions, and consequences arising from use or misuse of the Service.
10. Intellectual property
10.1. The Service, trademarks, logos, code, databases, and other elements belong to GH Software and/or its licensors and are protected by intellectual property rights.
10.2. These Terms do not transfer any ownership. Users receive a limited, non-exclusive, non-transferable, and revocable license to use the Service according to the selected Plan.
11. User Content
11.1. The User declares that they hold all rights needed over the Content submitted for analysis and releases GH Software from any third-party claims.
11.2. The User authorizes us to process the Content solely to provide the Service, improve features, and comply with legal obligations, in line with the Privacy Policy.
11.3. Submitted Content may be temporarily retained for analysis and auditing, and later anonymized or deleted according to the applicable retention policies.
12. Data retention and deletion
12.1. We retain personal data and usage history while the Account is active and for the time necessary to comply with legal obligations, audits, fraud prevention, and defense of rights, in line with applicable data protection laws.
12.2. After the Account is closed or the last subscription cycle ends, data may be kept for a limited period (for example, up to 2 years) solely for the purposes above, without public access or commercial use.
12.3. Accounts inactive for a prolonged period, or after the maximum retention period communicated in the Privacy Policy, will have all personal data and submitted documents scheduled for permanent deletion, including histories, reports, and usage records.
12.4. Before permanent deletion, the User may be notified by email for possible reactivation. After deletion, data cannot be recovered.
12.5. Anonymized data may be retained indefinitely, without the possibility of identifying the data subject.
13. Service availability, maintenance, and changes
13.1. We make reasonable efforts to keep the Service available and may perform scheduled maintenance.
13.2. We may change, suspend, or discontinue features, plans, and resources, with prior notice when appropriate.
13.3. Beta, lab, or experimental resources may have limited performance and support.
14. Support
We provide support via email (suporte@plagius.com) on business days, from 9 a.m. to 6 p.m. (BRT), for usage questions, fixes, and Service-related issues.
Special services (e.g., consulting, unlocks, personalized assistance) may be charged separately.
15. Protection of personal data
We process personal data in accordance with applicable data protection laws. See the Privacy Policy for details on data categories, purposes, legal bases, data subject rights, retention, and security measures.
16. Governing law and venue
These Terms are governed by the laws of the Federative Republic of Brazil.
The courts of Porto Alegre/RS have jurisdiction to resolve disputes, except when consumer law mandates a different venue in favor of the consumer.
